• Your access to and use of HOSTNOC.com (the “Website”) and any pertaining Services is subject exclusively to these Terms of Use (“TOU”). You will not use the Website/Services for any purpose that is unlawful or prohibited by these TOU. By using the Website/Services, you are fully accepting the terms, conditions and disclaimers set out in this notice.
• We reserve the right to update or amend these TOU at any time, and your continued use of the Website/Services following any changes constitutes your consent to such change. It is your responsibility to check the TOU regularly for any alterations.

The Website may provide a variety of resources such as e-mail, forums, and product information (collectively “Services”) designed to assist you and to enable you to communicate with us and/or other visitors to the Website. Unless stated otherwise, the Services are for your personal and non-commercial use only.

The information that we collect includes your name, email address, contact number and IP address. To help protect our clients’ online security, HOSTNOC uses advanced technologies such as Secure Sockets Layer (SSL) software that encrypts information entered during transactions.

• If a particular Service requires you to sign up for an account, you will need to complete registration by providing certain information and creating a username and password for use with that Service.
• You are responsible for maintaining the confidentiality of the username and password and for all activities that take place under your account. You agree to notify us immediately of any unauthorized use of your password or account, or any other perceived breach of security.
• Under no circumstance shall the Website be held accountable for any indirect or consequential loss or damage whatsoever resulting from the disclosure of your username and/or password.
• You may not use another person’s account at any time without the express permission of the account holder and HOSTNOC.

You acknowledge that all information, text, graphics, logos, photographs, images, animations, sound, illustrations and other materials (“the Content”), whether posted publicly or transmitted privately, is the sole responsibility of the creator. We do not control or endorse the Content and cannot guarantee the accuracy, integrity or quality of such Content.

In using our Website/Services, you agree not to:

• Use the Services to send junk email, spam, chain letters, pyramid schemes or any other unsolicited messages, commercial or otherwise.
• Post, publish, distribute or disseminate material or information that may be construed as defamatory, infringing, obscene, indecent, threatening, abusive, harassing or unlawful.
• Post, publish, distribute or disseminate material or information that incites discrimination, hate or violence towards any person or group on account of their race, religion, disability, nationality or otherwise.
• Threaten, abuse, disrupt, stalk or otherwise violate the legal rights (including rights of privacy and publicity) of others.
• Use any information or material in any manner that infringes any copyright, trademark, patent or other proprietary right of any party.
• Attempt to gain unauthorized access to any of the Services, accounts, computer systems or networks connected to the Website/Services through hacking, password mining or any other means.
• Engage in any other abusive activity that causes disruption in our operations (including inbound and outbound attacks).
• Use HOSTNOC services to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as pyramid schemes and chain letters.

We have the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including but not limited to breach of these TOU. We may also at any time, at our sole discretion, discontinue the Website/Services or any part thereof without prior notice, and you agree that we shall not be liable to you or any third party for termination of your access to the Website/Services.

If for any reason you wish to cancel your account within the first 15 days of setting up the account with us, we will issue a full refund (minus setup fees and surcharge charges) with no questions asked for shared accounts only. To request a refund, submit a cancellation request from the billing portal. Please note that the 15-day money-back guarantee applies only to shared and reseller hosting accounts and does not include the services listed below:

• Dedicated server / Cloud Server / any other VPS (Virtual Private Servers)
• SSL Certificates
• Any add-ons such as additional domains, databases, backups, dedicated application pools and/or any hosting add-ons or plan upgrades
• Any other services or add-ons, except base shared hosting accounts

We do not entertain pro-rated refund requests issued after 15 days of service. Accounts terminated due to a violation of HOSTNOC Terms and Conditions are not eligible for any refund. Accounts with pending dues or overages are also not eligible for refunds.

Any discounts, specials, or promotional prices displayed on our website are subject to specific terms, and their availability is limited to the dates stated. These discounts and specials cannot be used to replace any of your existing subscribed services. Failure to comply may result in discontinuation of any applied discounts or specials, and you will be billed at the full retail rates for the given service.

The subscriber is responsible for keeping a complete and current copy of their website files as a backup on a remote system (not solely on HOSTNOC servers). HOSTNOC is not responsible for any lost files, information or data. Although HOSTNOC backups may include subscriber sites and information for disaster recovery purposes, those backups are not to be relied on by the subscriber.

You agree to indemnify and hold the HOSTNOC Website harmless from and against any breach by you of these TOU and any claim or demand brought against the Website by any third party arising out of your use of the Services and/or any Content submitted, posted or transmitted through the Services, including without limitation all claims, actions, proceedings, losses, liabilities, damages, costs and expenses (including reasonable legal costs and expenses) suffered or incurred by the Website as a consequence of your breach of these TOU.

HOSTNOC reserves the right to suspend or terminate a client’s account if the client engages in any abusive behavior, including making threats, using derogatory or abusive language, complaining against HOSTNOC or its staff members, or making any public defamatory remarks on forums, blogs, or websites.
